Please read this terms and conditions very carefully before you purchase product from us. This documents refers the MHaque's  business online sale conditions and other legal issues for selling products online.

We are strongly suggesting our customer to read this terms carefully to make sure that you understood all terms before placing your order. However, you will be asked to accept this terms before you place any order.

We might change this terms from time to time as require. So every time you place the order, you must check the latest terms given on our website.

 

1. Definition:

1.1 We, us, our, I refer to seller ("MDHAQUE UK LTD") who will sell product on this website.
1.2 You, yours refer to buyer  who will purchase product from this website.
1.3. MHaque  refers to a trading name of the company named "MDHAQUE UK LTD".
1.4 'Days' refer to working days between Monday to Friday inclusive or exclusive Government's holiday or Bank Holiday, unless otherwise stated.
1.5  ‘Price’ means the price for the product excluding carriage, packing, insurance and VAT.
1.6 ‘Product Description’ means the description of the Goods provided on the Sellers website.

2. ABOUT US

Our company's name 'MDHAQUE UK LTD' a registered UK company(Registration number: 10899007). ' MHaque ' is our trading name. We are online retailer since 2011. We are pretty much selling everything on clothes, fashion accessories, house decor, kitchen ware, Kids item, and beauty & cosmetics items. Our slogan is 'MAKE LESS PROFIT TO INCREASE SALES VOLUME' which is why our product's price are very competitive then any other online retailer in UK. Most of our products are from UK's and Europe's authorised manufacturer and wholesaler. Our market place are in UK, Europe(Germany, Spain, France and Italy), USA, Australia. India, China and Canada. Our most popular branded are: Calvin Klein, Disney, Marvel Avenger, Puckator, Henbrandt, LI&HI, Bestway, Lesser & Pavey, ukgiftstoreonline, Junction, Mil-Tec, Ty, Giftwork, Fish around, Money boxer, Ted smith, Beanie Boos, Character world, Sambro, Star Wars, Dog studies, Elli & Raff, Emoji, Emporio Armani, Heaven Send, Jurrasic World, Leonardo, Manchester United, Teddy T's, and many more.

 3. CUSTOM'S ISSUES

Once you place the order from outside of EU, you might be liable to import duties and taxes, which are levied once the package reaches the designated address by you. Any additional charges for customs clearance must be your responsibility; we have no control over these charges. You must contact with your local custom's office to get more information about Customs policies which is vary from country to country. While you buy product from us from outside EU, you are considered a importer at your country from UK and you must follow the rules and regulation of an importer in your country. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

4. OUR LIABILITY

 

4.1 We are responsible for any loss or any damage you suffer which is foreseeable result and due to our failure to comply with this term. But we are not responsible for any loss or damage which is not foreseeable.

 

4.2. We are liable for any terms which is under the England law. But we are not responsible for any injury or death or accident which has happened due to following reasons and conditions:

a).  While shipping company delivering product to you.

b). After delivering product to you. Due to nature of the product's shape, product's material, product's ingredient, sharp edge of product's packaging customer might get injured if they are not careful enough while handling the products. Additionally, there are some cosmetics, house ware and kitchen wear items can be harmful for children if they(children) has been left next to the products without your attendance. It is your liability to receive, handle and keep the product safely away from children.

c) Any other reason, which is not visible and beyond our control.

d) Any unexpected issue happened after we handover the item to the shipping company.

 

4.3 We are not liable for any indirect and consequential loss or damage, loss in business, business interruption, or loss of your any business opportunity as our products are not for re-sell or for business. Our products are for only personal and domestic use.

 

4.4. We are not also responsible for any delay, failure to dispatch on time, under the terms which were out of our reasonable control including act of God, transportation strike, other industrial action, terrorist attach, riot, invasion, war(weather declare or not), road accident, cyclone, flood, natural disaster, continuous snowing, and any kind of other impossibility which were out of our control.

 

4.5 It is your liability to inform us well in advance about any claim, loss, liability, or damage arising from your side of these term and condition.

 

The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights.

5. FREE RETURN AND REFUND

 

We almost accept almost all returned item and give full refund once we receive the item back with unused in the original package. Additionally, we also sometimes pay for the return postage cost subject to following condition: 

a) if you are not happy due to delay of dispatch.

b) if we deliver defective product intentionally or unintentionally.

c) if we deliver wrong products

d) if we deliver damaged product or with damaged package and you returned the product unused in original package. We will need your proof of purchase such as invoice or receipt copy for that. FOR RETURNING ITEM, WE DO NOT COLLECT THE ITEM FROM CUSTOMER'S ADDRESS. It is your responsibility to dispatched the item back to us via any shipping method to our address given at our website homepage. Once we receive the item, we will check and will pay the full refund with your return postage cost subject to condition of the returned item.

 

For any of the above reason or for any other reason, if you want to return the product, you have to let us know by 5 days after you receiving the product ( receiving date) via email to customerservice@mhaque.co.uk. However, you can return the product until 28 days after purchase date. To get full refund, it is your responsibility to send the item back without making any damage of the product, product's sticker, product's label or logo. Otherwise, we may give you partial refund subject to the condition of the returned item. However, in some cases we even accept little damage with packaging which is repairable to give full refund with return postage cost. Customer need to wait 2-5 full working days(Exclude any bank holidays, week end, Christmas day, Easter, boxing day or any other government decided holiday) to get refund into their card or their account.

 

Note: If you receive damaged package, item damaged, item faulty, we need our customer to take picture of the damaged and inform us by 5 days from the delivery date. Customer need to wait 2-5 full working days to get refund into their card or their account.

 

6. EXCHANGE or REPLACEMENT:

 

We do accept exchange or replacement request from our customer if the same products are available in our stock. For this we also pay the return postage cost:

 a) if you are not happy due to delay of dispatch.

b) if we deliver defective product intentionally or unintentionally.

c) if we deliver wrong products

d) if we deliver damaged product or with damaged package and you returned the product unused with original package. We may need your proof of purchase such as invoice or receipt copy for that. You must write us for your replacement or exchange request via email to customerservice@mhaque.co.uk within 5 days after you received the item. However, you can make request for exchange or replacement until 28 days after you placed the order. Please mention your order number while you send the email to us. To get replacement or exchange, it is your responsibility to send the item back without making any damage of the product, product's sticker, product's label or logo. Returned item must be unused and with original package.

 

On the other hand, it is your responsibility to pay the return and replacement shipping cost, if you want replacement due to any other reason mentioned above subject to availability of the same product. We do not add any other new different product with exchange or replacing the item. For any new product you have to place new order from our website.

 

7. ORDER CANCELLATION: Customer has full right to cancel the order. You must inform us in written via email to - customerservice@mhaque.co.uk within 24 hours after placing the order before we dispatched the item. However, you still can cancel the order after we dispatched your order within 28 days after your ordered date. For that you have to return the item back to us on your own cost without making any damage of the product, product's sticker, product's label or logo. Otherwise, we may give you partial refund subject to the condition of the returned item. However, in some cases we even accept little damage with packaging which is repairable. We will try our best to give you best solution to resolve your problem. Please bear in mind that we do not pay the return postage cost while you return the item due to cancellation of your order.

 

If you cancelled the order before we dispatched the item, we will give you full refund straightway after your confirmation. On the other hand, if you cancelled the order after we dispatched your item, you will need to wait to get the refund until we receive the item back with unused and without making any damage of the product, product's sticker, product's label or logo.

7. DISPUTE MATTER:

 

If any of the dispute between you and us can not be resolved for any uncontrollable reason, you may seek to settle the dispute by submitting complaint to outside of court via the Online Dispute Resolution Platform by click here:  http://ec.europa.eu/odr.

 

 

8. APPROPRIATE LAW

We are governed and rely on English law. By this terms both of us(You and we) are agree that the court of England and Wales will have non-exclusive jurisdiction.

 

9. PROPERTY RIGHTS

We are the owner of the company name 'Protea Secur HR Ltd', trading name ' MHaque ', all logos and copyright given in our website. Any products which has came from different manufacturer or wholesaler are belongs to their property showing in our website. You do not have right to do copy of those any products from our website. You also do not have right to adapt, alter, modify any of the product for business purpose or for re-sell.

10. PRODUCTS details and warning

 

It is your responsibility to follow the rules given in product's label, sticker and instruction. For any injury, accident, and damaged we do not take any responsibility if you fail to follow the instruction given by manufacturer.

Some of our branded products come from directly UK's wholesaler or branded company's warehouse and it is legal requirement to remove label from those branded product to sell on our website. So you might find some branded products without label or label already been cut.

Some product might have come without enough protective packaging as those came directly from manufacturer without properly packaged. Some might come with only hanger or only with very thin plastic packet. However, we are always trying our best to deliver product with our own packaging if necessary. Some children's product or house decor item come with sharp edge due to product's shape. In that case, it is your responsibility to keep those product safe away from children. Please read instruction given on product packaging.

CHOCKING HARARD WARNING:  Some of our product also has little parts and separated pieces which might be risk for the kids under 3 years. Some products package are with strong plastic with sharp edge. Please be aware that it is your responsibility to keep those product away from children.

Product's description, colour and image: Our product's description given on our website are 100% accurate materially. However, the product's colour and images may vary a very little then the picture showing on our website. Due to the different colour resolution and graphics set up of your computer, you may find that the picture may be little more or less illustrative then the actual colour. Most of the products image you will find exactly matching with the product's actual colour. However, if you find any little different than the actual product's picture, you are always most welcome to inform us according to point 5 and 6. We will definitely find a better solution for you.

11. For CHILDREN

 

We do not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18 you may use our Services only with the involvement of a parent or guardian.

12. SHIPPING METHOD

We deliver parcel via Royal mail service. For extra security we use track and signed service from Royal mail which will give customer extra peace of mind. Note that, the customer himself or his representative should be available to sign and receive the parcel. If our delivery person does not find anyone to deliver the parcel, they will left with "A card while you were outside" or a card "We missed you". You will be given full details of the parcel on that card to contact with delivery office. You can call them to arrange for re-deliver the parcel again. If the delivery office does hear anything from you within 1 week after they left the card, they will send the parcel back to us. It mean, they will keep your parcel for 1 week at their local depot to hear from you to re-deliver the parcel. It is your responsibility to contact with them for arrange re-delivery. However, you can contact with us as well for your parcel information. If your parcel get returned back to us, you may need to pay same shipping cost again for the parcel to deliver again.  This re-delivery process is for only UK's customer. Delivery include to the Scottish Highlands and Islands and the British Forces Post Office (BFPO)

For Europe and other parts of world's customer, arranging re-delivery depends on individual country's courier service. Customer need to contact with their local courier or shipping company for more information. However, we always trying to inform the schedule of delivery time. So that, the customer will always be aware of it for not to miss the parcel. Please check the schedule delivery time while you place the order.

[ Important note: We do not charge VAT for USA, Canada, Australia, China, India, Bangladesh. However, they might need to pay VAT while they receive the product from shipping company or from their local customs office. Customer from USA, Canada, Australia, China, India, Bangladesh are advised to contact with their local customs office for the VAT information of their purchased product. ]
